JPEDLAB iOS App Terms of Service

These Terms of Service (the "Terms") set the conditions for using the JPEDLAB iOS app provided by MANAB LLC (the "Company"). Users must use the App in accordance with these Terms.

Article 1 (Applicability)

1. These Terms apply to all relationships between users and the Company arising from use of the App.
2. The Company may establish rules and other provisions for the App. Regardless of their names, those provisions form part of these Terms.
3. If these Terms conflict with an individual provision, the individual provision prevails unless otherwise specified.

Article 2 (iOS Account)

1. An anonymous JPEDLAB iOS account is created when the user agrees to these Terms and completes onboarding by the method prescribed by the Company.
2. The App account does not link to JPEDLAB web accounts and does not provide sign-in through external authentication services such as Google, Microsoft, or GitHub.
3. Users are responsible for properly managing the App session, device, Apple Account, and information needed to restore purchases.
4. Free learning progress may not be recoverable after deleting the App, changing devices, or deleting the account. Valid App Store purchase entitlements may be restorable according to Apple's mechanisms.

Article 3 (Fees and App Store Purchases)

1. Users pay the fees shown in the App and on the App Store purchase confirmation sheet through Apple's App Store in-app purchase system.
2. Subscriptions are continuous contracts and renew automatically at the end of each period. Renewals are charged to the Apple Account, and users can manage or cancel at any time in App Store account settings. After cancellation, access remains available until the current period ends.
3. One-time purchases do not renew automatically.
4. Account deletion, App deletion, and device changes do not cancel App Store subscriptions. Cancellation must be handled separately in the Apple Account.
5. Purchases can be restored from Restore Purchases in the App. Deleted learning progress and submitted content are not restored.
6. Refunds for App Store purchases are processed under Apple's rules and procedures.

Article 4 (Prohibited Conduct)

Users must not engage in the following conduct when using the App:
・Conduct that violates laws or public order and morals
・Conduct related to criminal acts
・Conduct that interferes with the servers, networks, or systems of the Company, other App users, or third parties
・Conduct that may interfere with operation of the App
・Collecting or accumulating personal information about other users
・Unauthorized access or attempts thereof
・Impersonating another user or third party
・Infringing intellectual property rights, portrait rights, privacy, reputation, or other rights or interests of the Company, other App users, or third parties
・Posting or transmitting excessively violent, sexual, discriminatory, self-harm-inducing, drug-abuse-inducing, or other antisocial content
・Using the App for purposes different from the intended learning purpose
・Religious activities or solicitation for religious organizations
・Improper use of purchase entitlements, tickets, credits, or refund systems
・Other conduct the Company deems inappropriate

Article 5 (Suspension of App Provision)

1. The Company may suspend or interrupt all or part of the App in cases of system maintenance, failures, communication line outages, disasters, legal compliance, external service outages, or other cases the Company deems necessary.
2. Except where required by law, the Company is not liable for disadvantages or damages suffered by users or third parties due to suspension or interruption of the App.

Article 6 (Copyright and Content)

1. Intellectual property rights in the App and all related text, images, audio, video, data, programs, and other content belong to the Company or rightful owners.
2. Users represent that they have the necessary rights or permissions for text, audio, and other information they send through the App.
3. The Company may use information sent by users within the scope necessary to provide the App, improve quality, fix defects, provide support, prevent unauthorized use, and fulfill the purposes set out in these Terms and the Privacy Policy.

Article 7 (Usage Restrictions and Account Deletion)

1. If a user violates these Terms, false information is discovered, payment obligations are not fulfilled, unauthorized use is suspected, or the Company otherwise deems use of the App inappropriate, the Company may delete submitted data, restrict use, or delete the account without prior notice.
2. Users can delete their account in the App settings. Records required for law, accounting, payment processing, refund handling, security, fraud prevention, or dispute handling may be retained after account deletion.
3. Account deletion does not cancel App Store subscriptions.

Article 8 (Disclaimer of Warranties and Liability)

1. The Company does not warrant that the App is free from factual or legal defects, fits a user's particular purpose, or produces learning outcomes.
2. The Company does not warrant the accuracy, completeness, usefulness, currency, or fitness for a particular purpose of responses, explanations, information, or other content provided by AI features ("AI-Generated Content"). AI-Generated Content is not a substitute for professional advice, and users use it at their own responsibility. AI-Generated Content is not used for model training in a form that identifies the user.
3. Teacher pronunciation feedback is learning support and does not guarantee immediate replies, a particular quality level, or learning outcomes. Tickets are for teacher pronunciation feedback audio correction and are not online lesson reservation rights.
4. The Company is not liable for damages suffered by users arising from the App, except in cases of the Company's intent or gross negligence. This does not apply where liability limitations are restricted by the Consumer Contract Act or other laws.

Article 9 (Changes to Service Content)

The Company may change, add, or abolish App content with prior notice to users. However, changes may be made without prior notice for urgent maintenance, security, fraud prevention, legal compliance, or other unavoidable circumstances.

Article 10 (Changes to Terms)

The Company may change these Terms when the change conforms to users' general interests, or when the change is reasonable in light of its necessity, the appropriateness of the changed content, and other circumstances. Important changes will be announced in the App or on the Company website.

Article 11 (Handling of Personal Information)

The Company handles personal information and usage data obtained through use of the App appropriately in accordance with the "JPEDLAB iOS App Privacy Policy."

Article 12 (Notices and Communications)

Notices and communications between users and the Company are made by methods prescribed by the Company. Inquiries can be sent to contact@jpedlab.com.

Article 13 (Prohibition of Assignment)

Users may not transfer or use as security their status under the App use contract or rights or obligations based on these Terms to third parties without the Company's prior written consent.

Article 14 (Governing Law and Jurisdiction)

1. These Terms are governed by the laws of Japan.
2. Any dispute regarding the App is subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's principal office.
